Did HUD and SBA Think Through Their Latest BLM Companies Nightmare?!

Foreclosurepedia had the opportunity to receive exclusive information, earlier today, on where Strategic Alliance Management JV LLC (SAMJV), the US Department of Housing and Urban Development (HUD), Management and Marketing (M&M) Field Service Manager (FSM) 3.10 Awardee is located. Yesterday, Foreclosurepedia released a scaything article on information we found pertaining to Tony Chinye, owner of Chinye and Company, PA, and the co-owner of SAMJV. PK Management is the other co-owner. PK Management is a National Association of Mortgage Field Services (NAMFS) member. What we found out today completely boggles the mind. I have opined, in the past, about encouraging small businesses to participate in federal contracting. Sometimes it is a good thing, regardless of my rhetoric, and sometimes it is a scary thing. In the case of SAMJV LLC, it doesn’t exist according to the evidence we received today.

We know that Tony Chinye has paid business taxes through the Broward County Tax Assessor since 2006 for 1911 NW 150 Avenue, Suite 202, Pembroke Pines, Florida. Granted, that doesn’t jive with his reported 17 years of existence, but it is a start. Foreclosurepedia spoke with the Broward County Tax Assessor’s office (BCTA) today whom stated they had no record of a SAMJV LLC located at 1911 NW 150 Avenue, Suite 202b, Pembroke Pines, Florida. BCTA advised Foreclosurepedia that to legally do business in Broward County at the aforementioned address, Florida Law required that SAMJV LLC possess a business license and currently — and since 2014 when they were founded — they have not had one.

Foreclosurepedia reached out to the US Small Business Administration (SBA) Office of the Inspector General (OIG) and requested an Inquiry. The issued Complaint Number 14837, which may be retrieved via the Freedom of Information Act (FOIA), deals with the fact that I find it incredulous that no one ever took the time to ask the simple and salient questions Foreclosurepedia is. Moreover, though, why was no site visit or business license check ever performed?!

HUD’s position is pretty clear,

Pre-certification of 8(a) Joint Ventures only applies to 8(a) set-asides, which the FSM 3.10 solicitation was not (it was regular SB set-aside only).  That means that while the prior agreement had been pre-approved by SBA, the fact that the prior JV approval had expired did not preclude them from executing a new JV prior to the solicitation date, as no SBA approval was required for the non-8(a) set-aside. I don’t know if any other awards were made to the same JV during the 2 year period, but there is an existing rule that no more than 3 awards can be made to the same JV within a 2 year period.  Additionally, if challenged as a SB size protest, they’d also still have to avoid any other affiliations that would cause the JV to be considered large.

Or how about simply being affiliated with PK Management a HUD M&M FSM Awardee in multiple states?! There is no mistaking the fact that 1911 NW 150 Avenue, Suite 202, Pembroke Pines, Florida, is a hub for multiple operations under the Chinye Umbrella. It would be ludicrous to say that there were no affiliations ongoing or that Chinye himself did not financially benefit in any way, shape, or form from those aforementioned relationships wherein he is legitimately involved with. Now, whether or not HUD or SBA will do anything, I do not know. Whether I will end up tomorrow morning with a .38 caliber slug in the back of my brain, I do not know. What I do know is that if HUD allows the non existent firm of Strategic Alliance Management JV, LLC, to fly, chances are pretty good that Trump Tower is in on the fix.
