After liaising with law enforcement personnel investigating the SEAS LLC debacle, it has become apparent that for they to properly accomplish their investigations and for those victims to be properly assembled, a detailed Article needs to be brought forth. Currently, there is no official statement to be released from South Carolina nor Florida with respect to that which Foreclosurepedia has reported upon. What we know for a fact is this:
A landslide of phone calls to the Hillsborough County Sheriff’s Office (HCSO) began after a victim in South Carolina presented a worthless check for $10,000. That check was turned over to a Lieutenant in the Anderson County Sheriff’s Department whom, in turn, liaised with a Lieutenant in the HCSO Economic Crimes Division (ECD).
We know for a fact victims of Tom and Mark Newkirk along with Robert Kapeluch are strung across the entire Eastern Seaboard. Foreclosurepedia is currently attempting reach all of them and obtain their information for presentation to proper law enforcement officials.
There is a jurisdictional quandary which, I personally believe, that each and every Member of the National Association of Mortgage Field Services (NAMFS) whom commits this type of fraud counts upon. As none of these NAMFS Members possess legal licenses to operate even outside of their own county, law enforcement is hamstrung to even locate many of them. In the instant case, HCSO is only capable of investigating complaints within their jurisdiction. As we all know, within minutes of spinning down SEAS LLC, Robert Kapeluch opened up Tower Property Preservation LLC in his basement. He did this without even obtaining a business license.
We spoke with Tammy at the Hillsborough County Tax Collector’s Office. She ran a check while we were on the phone and stated, “…the business license was pulled on the 23rd of March 2015.” So, Kapeluch had the money to finally pull a tax license, but why not pay Labor the money he owes? Or, is Kapeluch going to hang the Newkirk’s out to dry in exchange for a plea deal? I don’t know, but maybe one might ought to ask Kapeluch!
HCSOs dilemma is that they are only allowed to investigate complaints pertaining to crimes alleged to have been committed within Hillsborough County. I empathize with this in part and disagree with it in part. What I mean is this: If SEAS LLC commits a crime within the jurisdiction of Hillsborough County the corpus — the body — of the crime is there. So, if Kapeluch is signing bad checks he is doing so in Hillsborough County. Now, we know he placed at least one of the checks in the US Mail and this, if Kapeluch is found to be criminally negligent, brings up a federal jurisdictional issue. The racketeering and conspiracy element between Tom and Mark Newkirk along with Kapeluch raises yet another issue as well. Personally, I believe this should have been turned over to the Federal Bureau of Investigation (FBI) and maybe it will at some point in time. For now, though, HCSO has determined the following:
If you are a victim of SEAS LLC and reside in Hillsborough County, Florida, contact the HCSO Economic Crimes Division to file your complaint. If you reside outside Hillsborough County, contact your local law enforcement to file a complaint and indicate there are ongoing investigations in both Anderson County, South Carolina, and Hillsborough County, Florida. Personally, I would refer them to Foreclosurepedia where they will be able to get up to speed on the length and breadth of the matter.
