FIRRA, Dodd – Frank, NAMFS and HUD M&M 3.7

Part One of Two:  On March 8, 2016 the Securities and Exchange Commission (SEC) wired $750,000 into the bank account of Eric Hunsader as a whistleblower award for spotting and documenting an illegality at the New York Stock Exchange. And therein lies the rub as the Bard would say.

Bellwether forecasting is most easily performed by looking no further at how financial institutions treat the very military whom protects their right to rape and plunder. Times are tough and you know what, our men and womenJamie Dimon whom are abroad fighting for an Emperor Whom Wears No Clothes, are taking it straight up the ass from the Big Five like Bank of America and Wells Fargo. This is well documented by the latest round of complaints to the Consumer Financial Protection Bureau (CFPB) whom, according to National Mortgage News

Military families and service members are submitting debt collection complaints to the Consumer Finance Protection Bureau at twice the rate of other consumers. — National Mortgage News Lead with video commentary. Problem is that the commentary does an injustice to the precise problem of the scale of the wholesale rape!

C’mon Jamie. I mean I understand you get off fucking the common man; however, the military, REALLY?! — My thanks to a colleague for the use of REALLY to place an emphatic label upon something which is so incredulous that it merits emphasis!  😉

The Financial Institutions Reform, Recovery and Enforcement Act of 1989, H.R. 1278, was introduced and ran up America’s still subprime gaping asshole by Henry B. Gonzalez (D-TX) on March 6, 1989. This, according to the Government Printing Office. It is cited as, An Act to reform, recapitalize, and consolidate the Federal deposit insurance system, to enhance the regulatory and enforcement powers of Federal financial institutions regulatory agencies, and for other purposes. — It is the final four words, and for other purposes, that makes one’s asshole pucker up so tight you cannot get a stick pin through it at 0308 hours while wading through the Emperor Whom Wears No Clothes’ legalese.

FIRREA dramatically changed the savings and loan industry and its federal regulation, including deposit insurance. The “Paulson Blueprint” summarized it in the following:[2]

  1. The Federal Home Loan Bank Board (FHLBB) was abolished.
  2. The Federal Savings and Loan Insurance Corporation (FSLIC) was abolished, and all assets and liabilities were assumed by the FSLIC Resolution Fund administered by the FDIC and funded by the Financing Corporation(FICO).
  3. The Office of Thrift Supervision (OTS), a bureau of the U.S. Treasury Department, was created to charter, regulate, examine, and supervise savings institutions.
  4. The Federal Housing Finance Board (FHFB) was created as an independent agency to take the place of the FHLBB, i.e. to oversee the 12 Federal Home Loan Banks (also called district banks) that represent the largest collective source of home mortgage and community credit in the United States.
  5. The Savings Association Insurance Fund (SAIF) took the place of the FSLIC as an ongoing insurance fund for thrift institutions (like the FDIC, the FSLIC was a permanent corporation that insured savings and loan accounts up to $100,000). SAIF is administered by the Federal Deposit Insurance Corporation.
  6. The Resolution Trust Corporation (RTC) was established to dispose of failed thrift institutions taken over by regulators after January 1, 1989. The RTC will make insured deposits at those institutions available to their customers.

While the entirety of the theory of whistleblowing may be unknown to many, the reality is that within the circle as it stands right now, we are observing, at best, a shot across the bow. That is not the story which we have today, though. That, though, is a story not to be told out of shop — yet!

Meandering through the cesspool quagmire which I refer to as the federal judiciary, are a series of Protests naming all the usual suspects like United States and the US Department of Housing and Urban Development. HUD’s wet dream, officially known as the Management and Marketing (M&M) 3.7 Asset Management (AM) Contract, has more holes in it than Carter has liver pills.

Look, this is the type of bald faced fraud that even makes the Mafia and their Russian Cousins blush! In fact, I have a source speaking on condition of anonymity whom put it most poignantly,

[…] It was that this [the HUD M&M AM 3.7] looks like it will turn out just like the 3.5 out west.

What what my source is referring to was the HUD’s original M&M 3.5 Contract as we discussed in an earlier series of articles. What we know for certain is that The Fox Guarding The Henhouse, #OpHenhouse, is still alive and well. As we begin to look through what portions of the record we are allowed access; as US Taxpayers are treated to a Kafkaesque Docket when they inquire as to whom is stealing what. We know that yesterday REO Solutions®, an REO NATIONAL SM Company, had their shot at the at their shot at the protest — this was sealed.

[tnc-pdf-viewer-iframe file=”https://foreclosurepedia.org/wp-content/uploads/2016/03/REO-Solution-File-Under-Seal.pdf” width=”800″ height=”800″ download=”false” print=”false” fullscreen=”true” share=”true” zoom=”true” open=”true” pagenav=”true” logo=”true” find=”true” language=”en-US” page=”” default_zoom=”auto”]

We know for a fact that Precision Asset Management had their Protest heard, and we know that today,  30th March 2016, Q Integrated is up to bat — all under Seal.

What we have to ask ourself, as a society, is do we want the sterile and cleansing rays of transparency; the very same hollow policy which the Obama Administration’s promise and commitment to an open and transparent government, to radiate upon HUD’s cesspool? Do we want to see the clear and transparent record in a manner in which Foreclosurepedia supports on it’s website? Or do we want only GS-15’s with TS-SCI, Umbra or 1600 clearances viewing such and issuing Talking Points via Craig Karnes? I mean there is no way in fucking hell that the ENTIRETY of these records should be redacted!

My Administration is committed to creating an unprecedented level of openness in Government.  We will work together to ensure the public trust and establish a system of transparency, public participation, and collaboration. Openness will strengthen our democracy and promote efficiency and effectiveness in Government. — The White House quotes Barack Hussein Obama II on transparency.

While articles like: The U.S. Supreme Court on Monday rejected a bid by several big banks to review an appellate decision that revived the Federal Deposit Insurance Corp.’s lawsuit alleging that they lied in the marketing materials and sales of around $2.1 billion in mortgage-backed securities, are the Drive By Media’s darlings, the reality is that there is nothing under The Emperor’s Sun which is new. Fact of the matter is that that Goldman Sachs, Deutsche Bank, and Royal Bank of Scotland got an interest free loan and between the three leave more than that at Ruth’s Cris for a tip at lunch.

The federal judge appointed over All The Kings Men in the HUD debacle should be, at minimum disbarred. I say this because of the Salient fact that what we have here is, part and parcel, precisely what Organized Crime applauds: temporary restraining order and preliminary injunction issued at the eleventh hour and without Public Inspection. What we have here is nothing more glamorous than sugar coated censorship, ladies and gentleman. I submit to you, in the way that only a trained media professional such as myself can do.

What we are allowing is the criminality of Government Contracting to take place under the cloak of darkness and with some protection is going to march out under the cover of the federal judiciary. I do not make this statement lightly ladies and gentleman.

Look I am no different than the next contractor down the block. I roll up my shirt sleeves; I stick my hand into the latrine and the very feel that these shitters are no different than the Paper the Contracts are written upon. That is right. What I am stating is that there is no separation when juxtaposed between a filthy latrine and the Contracts which Karnes and his ilk are putting forward.

Now, we all remember Kevin Simpson and his threat of black helicopters under Title 18; the very same Provisions which are used right now to keep Edward Snowden in Moscow, well,we are going to discuss he and the rest of this insanity in Part Two.  Simpson may come forward and and threaten all types of manifestations of evil against myself and my family; Simpson, et al., may attempt to intimidate those who choose to Bear the Standard of the Foreclosurepedia Nation. And the National Association of Mortgage Field Services (NAMFS) most assuredly may target the very brave men and women whom fuel the Mortgage Field Services Industry. Foreclosurepedia, though, is the Beacon of Light shining out of the Wilderness. We hold the line so you don’t have to!

Before You Go ...

Foreclosurepedia exists because readers, workers, and advocates understand that protecting Labor in the mortgage field services industry requires independence, persistence, and resources. We do not answer to servicers, hedge funds, or corporate trade groups; our accountability is to the Field Service Technicians, Inspectors and administrative personnel whose livelihoods are too often treated as expendable. Donations are what allow us to investigate quietly buried contract changes, expose abusive labor practices, and publish work that would otherwise never see the light of day. Every contribution helps keep our reporting free from industry pressure and focused squarely on defending labor standards, fair pay, and basic dignity in the foreclosure ecosystem. If you believe this work matters, your support is not symbolic—it is the reason Foreclosurepedia can continue to stand between Labor and a system that routinely exploits it.
