NAMFS: The Not So Non Profit As They Would Have You Believe

The National Association of Mortgage Field Services (NAMFS) Regime can’t seem to catch a break lately. With former Members of the NAMFS Regime Board facing Fraud Charges in Federal Court — that would be Heather Berghorst the disgraced, former NAMFS Regime Secretary now on Bankruptcy Two — with challenges to its Premiere Trade Association Status by other Trade Associations, it would seem that perhaps Eric Miller might want to face the facts that his tenuous dictatorship is failing and becoming forthright and honest might be a good course of action. Miller doubled down. As if Miller & Co.’s illegal appointment of Joe Hummel, co owner of Keystone Property Services, was not enough — and on that note we are drilling down on Keystone Property Services Contractors as I type to MAKE SURE they are doing it the legal way as these are Safeguard Properties Work Orders — the NAMFS Regime is going to have an Official 13909 to deal with. Now, to set the record straight on precisely how long Eric Miller and his partners at the trough have been aware of problems, take a look at the NAMFS Regime’s own website. This is a testament to the level of both stupidity and incompetence demonstrated,

Dispute
Have you established a dispute area for disputes with companies that refuse to pay for work performed? Assurant is refusing to pay many of its contractors over the last few months and is now refusing to pay us for work completed and accepted by them. We have done work for other companies that also contract with Assurant that are in the same situation as us. Submitted By: Scot St. Hilaire

Regional Officer who is defrauding contractors

One of your regional officers, Rich Frarruggia of RDM Property Maintenance, is several months in arrears paying at least two Toledo contractors. He no longer answering phone calls after purposely mis-leading us and delaying payments that have never come. If you could advise us on a course of action it would be much appreciated. Non the less I thought you should know that this gentlemen is a poor person to have represent your membership. Sincerely, Roger Bucher President, Bucher Patterson Construction LLC. Non Payment of Invoices by Nomad Preservation, Inc. Texas

I would like to inform you that I did preservation work for Nomad Preservation, Inc. from March to August 2009 totaling $15,084.00 and have not been paid for said work orders. I think that their membership should be revoked as they are not taking phone calls or emails from contractors that they hired to do preservation work in Florida and have not paid for the completed work. Members behaving badly

We were hurt badly by the actions of a member company of yours, and several of the other contractors we know are still being adversely affected by the unscrupulous practices of this company (which has just chanegd names). This company does not measure up to the standards of your organization and uses their membership in NAMFS to bring credibility to their operation that they do not deserve. How would their contractors file a complaint with NAMFS to have them removed for violation of the canons and standards? We agreed to work with them due to their association with NAMFS and do not want to see other contractors or comapnies hurt like we were. Submitted By: Todd Crane

Eric – I think the issue with the email is when you are log in as a user the email above is blank so I just put in my address. When you are logged in it defaults to put in [email protected]. Is the intent to have the user, know who to email from this page? Should someone be able to send feed back if they do not have a log in? Just some thoughts as I tested again. Kris Submitted By: Demo User — Added to document that Eric Miller has been well aware of issues since 2008

So, for WELL OVER FIVE AND A HALF YEARS NOW, Miller & Co. have been aware of problems which they have continued to sweep under the carpet. So, I feel on pretty solid ground that we are moving over from the civil into the criminal — unless Miller and what I perceive to be his co conspirators have information contradicting the record. As early as 10 March 2009, there were problems at the Palace.

Forelcosurepedia released today the incontrovertible fact that the National Association of Mortgage Field Services (NAMFS) DOES NOT HAVE a Letter of Determination as a Non Profit issued by the Internal Revenue Service (IRS).

It gets worse, though. As early as November, 2013, the NAMFS Regime admitted it had “financial oversight” with respect to Aspen Grove Solutions and their Background Checks.

That said, NAMFS were not part of the initial pricing conversations but now do have financial oversight going forward and is working with the Aspen on their commitment to pass on in full any cost savings that occur as the solutions develops and is implemented. We are in discussions with two other background check companies at this point in time.

So, the not so non profit, non profit, would seem to be doing just a wee bit more than a Trade Association should be allowed to. Here is where I get confused, though. So, a non profit formed in Delaware; the offices which have been spread out from Florida to Ohio with multiple changes of address, has no Letter of Determination from the IRS. How is it then, precisely, that the NAMFS Regime does not have to pay taxes upon the funds it collects? I mean clearly, in the above referenced paragraph from NAMFS, Members of the Board are actively engaged in the “financial oversight” of for profit firms such as Aspen Grove Solutions.

You know, strike that. Here is the more, on point question. Now, the NAMFS Regime was out wagging its proverbial dick over the fact that they got THREE DOLLARS in savings back for NAMFS Regime Members. I mean are you goddamn shitting me?! Here, take a read of the Internal NAMFS Document,

The good news continues, as we have also been able to secure a $3 reduction in the background check fee which will take place with immediate effect.

As early as 2012, the National Association of Mortgage Field Services (NAMFS) questioned the validity of its Membership being involved in Charge Backs. In fact, NAMFS leveled the blame squarely upon the shoulders of Robert Klein, et al. Here, take a read from the NAMFS Regime’s Internal Play Book,

Curious about how Mortgage Contracting Services (MCS) is getting paid? Well, they did a great presentation for those at the trough. We though Contractors might like to know. I mean especially in light of the fact that 24 Asset Management, a BIG NAMFS Regime Player, just brought on some of MCS’s sister company’s talent — that would be Asset Management Specialists (AMS) and the names are Lee Mertins and his close, close buddy Brian Nesbit.

I am always simply speechless when I continue to find the Contractors out there whom believe it makes far more sense to remain silent and never partner up with each other. Let me tell you what would shut this down tomorrow morning: A Strike. Period. Give me 50 Contractors in strategic regions in the Midwest and I guarantee you a ten percent cap — period! I am close, right now. In all honesty I do not want ALL the Contractors. In fact, I really want less than 15% of the current Contractors out there to make the cut — and the cut is coming, folks.

Craigslist currently has 12,204 Mortgage Field Services Industry positions available. Now, I have reached out to Craigslist to get statistics to prepare a Fusion Table based since 2008. The reality is that the NAMFS Regime is in DIRE NEED of hacks to replace those their Members have defrauded. The reality is that, if strategically orchestrated, a Strike would cause losses in the TENS OF MILLIONS OF DOLLARS PER WEEK.

I have every intention of speaking with those involved with the Midwest REO Association and I feel confident that they will appoint a proxy to eventually speak with me. Make no mistake whatsoever that I propose to rally Labor around they and other similarly situated Associations provided that Midwest REO agrees to several undisclosed benchmarks. I want that to sink in a moment. What I am saying is that if Labor will rally around not Companies, but an ASSOCIATION of Companies, whom agree to play ball, Labor could change the tide.

When Regional Firms, whom have been vetted by the ISTAR Clear Base, are involved in Associations, the reality is that they need Labor. The further reality is that the current portfolio holders are NAMFS Regime Members. If Labor chose to walk from the NAMFS Regime Members and instead work for ISTAR Clear Base Approved Associations, the NAMFS Regime Members go bankrupt and the criminality ends — at least for the near future.

Through this process, Labor is not only able to ensure that they are paid, but in essence to somewhat determine whom is Awarded these gargantuan portfolios. By and through a network of back channel resources, it is very simple to communicate where Labor is going to move and when. Financial Institutions, Government Sponsored Enterprises (GSE) and Portfolio Holders are faced with two choices. First, they could continue to support the NAMFS Regime Members and then miss the mandatory deadlines in the foreclosure process. Second, they could make the wise choice and support a legal, free market landscape.

Before anyone gets out there pissing about legality, I am more than willing to roll the dice and head to court against any of the NAMFS Regime Membership. Tomato, tomahtoe. Younion, Union. The reality is that Robert Klein and the boys would be hard pressed to open their books and we all know that Eric Miller is just about as chicken shit as they come. No way the wifey is going to risk him loosing out on the perks he is getting now.

So, I am accelerating a plan known as #OpMeridian earlier than I had intended. ISTAR Clear Base is pretty much finished from an infrastructure point-of-view. The ISTAR Forum has been set up and will improve over the next several weeks as Donations come in to finance it. I am additionally going to formally announce my attendance at the Florida FAST November Conference. As opposed to the July FAST Event. November’s will not be open to those Order Mills whom have not been cleared through ISTAR Clear Base. In anticipation, Foreclosurepedia will formally announce the Official FAST Website this weekend and we plan to have Bret Douglas, Ironclad Preservation owner and FAST Founder as our guest on the Foreclosurepedia Podcast.

Before You Go ...

Foreclosurepedia exists because readers, workers, and advocates understand that protecting Labor in the mortgage field services industry requires independence, persistence, and resources. We do not answer to servicers, hedge funds, or corporate trade groups; our accountability is to the Field Service Technicians, Inspectors and administrative personnel whose livelihoods are too often treated as expendable. Donations are what allow us to investigate quietly buried contract changes, expose abusive labor practices, and publish work that would otherwise never see the light of day. Every contribution helps keep our reporting free from industry pressure and focused squarely on defending labor standards, fair pay, and basic dignity in the foreclosure ecosystem. If you believe this work matters, your support is not symbolic—it is the reason Foreclosurepedia can continue to stand between Labor and a system that routinely exploits it.
