Disgraced and former National Association of Mortgage Field Services (NAMFS) Secretary Heather Berghorst and her husband Doug Berghorst are currently being sued for Fraud. Following the legal theory which Foreclosurepedia elucidated upon weeks ago, Arrow Craft Construction, LLC, filed an adversarial challenge to Heather and Doug Berghorst’s Chapter 7 (Complete Discharge of Debt) under 28 U.S.C. § 157(b)(2)(I). The case is codified as 14-80204-jtg and was filed in the US Bankruptcy Court For The Western District Of Michigan Southern Division this month. Paragraph 16 of Count I lays out most poignantly what I have been saying for over a year now,
DEFENDANTS FRUADULENTLY SPENT AND SQUANDERED THESE FUNDS AND INCURRED OTHER DEBT WHILE ACTING IN THEIR FIDUCIARY CAPACITY CREATED BY MCL 570.151, ET SEQ., COMMONLY KNOWN AS THE MICHIGAN BUILDERS TRUST FUND ACT (“MBTFA”)
Altisource’s Associate General Counsel knew as early as October, 2013, about the improprieties ongoing at Berghorst Enterprises. It was not until May, 2014, that Altisource finally spun down the Fraud Corridor streaming money to Heather Berghorst. In fact, even after Altisource began to shut down operations with Berghorst Enterprises, Altisource reengaged Heather Berghorst under yet a different Company named Heritage Home Solutions. Proper Due Diligence would have revealed not only that Heritage Home Solutions did not exist as a legal entity, but it was owned by Heather Berghorst, as well.
Foreclosurepedia is the first and only Media Outlet to obtain copies of this litigation (see below) which supports our
contention that Heather Berghorst has been guilty of fraud and that in our opinion, Altisource has been complicit in Berghorst’s atrocities by not stepping in nor reporting her to the US Department of Justice. Foreclosurepedia additionally believes that Eric Miller and the entirety of the NAMFS Regime Board of Directors shoulder equal blame in that they still have Berghorst Enterprises listed as a Member in Good Standing upon their Roll Call and both Heather and Doug Berghorst are listed as attendees to the NAMFS Fraud Fest 2014 this week in Orlando.
Heather and Doug Berghorst were properly served yesterday. What a photo op regardless of whom accepted the Service of Documents! The reality is that as hard as both the NAMFS Regime and Altisource vis-a-vis their Associate General Counsel try to bury this disgraceful defraudment of innocent men and women, at least one Company had the balls to stand up. This lawsuit should stand as a testament to those Contractors whom have buried their faces in their hands and continued to lick the boots of those whom continue to screw them one work order at a time. Just because someone files bankruptcy DOES NOT MEAN that they are untouchable!
So, while A Todd Almasian (P 55467) is preoccupied with the tax breaks he received for his new office, perhaps he should not
have counted his chickens before they hatched. And make no mistake that Berghorst is the only Altisource fraudster out and about. What with Buczek Enterprises selling off their million dollar office complex and refusing to send a dime to Contractors while taking baths in the bags of cash Altisource sent them; while Jay Goscinki is still implicated in the falsified Mold Documents that potentially endanger human life and Altisource turns their noses up in the air, Foreclosurepedia will stay on top of the fraud and corruption which have come to identify both the name Altisource and the career of their Associate General Counsel in my mind.
As a final note, we reached out to the attorney of record, Ezra N Goldman, and have offered complete and unfettered access to all of our email communications between Foreclosurepedia and Altisource. Foreclosurepedia never has nor ever will be a part of corruption nor the perceived cover ups thereto. This is a telegraph that while the mechanisms of justice are cumbersome, with the proper lubrication they eventually engage. When they do engage they are generally more difficult to stop. In essence, Altisource should have simply paid the Contractors that which they were owed and sent a 1099 to Berghorst!
