I received a call yesterday from Safeguard Properties Legal Department. The thick, foreign accent made it almost impossible to decipher what the foreign woman was rambling; however, I finally was able to ascertain some salient accusations by her as an agent and employee of Safeguard Properties against Foreclosurepedia the Company.
About a year and a half ago, we did some grass cuts for Pinelands Preservation, a foreign corporation from New Jersey operating in California. Those grass cuts were sub contracted from Safeguard Properties until Pinelands Preservation finally determined that there was no money to be made and dropped Safeguard Properties in Tennessee.
The foreign mouth piece of Safeguard Properties hit the ground running by stating that a home owner was making claims against Foreclosurepedia the Company for theft on a non foreclosed property. I asked the name of the homeowner and that was unknown. I then asked the address of the property we were alleged to have cut the grass at and here is where, in typical Safeguard Properties flourish, the story became the typical hustle that Amir Jaffa and Robert Klein have pioneered,
The foreigner stated that we had never been to the Lisa Lane, Bean Station, TN, address. She reaffirmed what I already knew as my memory is long and distinguished, “Well, you never found the property.” I like that. Here Safeguard Properties was making BASELESS LEGAL ALLEGATIONS AGAINST A WOMAN OWNED BUSINESS.
Robert Klein and Amir Jaffa like to rely upon the stand by that they are Orthodox Jews. The problem is that the discrimination card is a two way street. I am agnostic. I am also a Member of the Media and no longer provide Services to Foreclosurepedia the Company pertaining to that aspect of the Company. So eager was the foreigner to knock one out of the park; so eager was the foreigner to Strike a Mighty Blow For Safeguard Properties, that the foreigner never asked if the owner was available. Bad move Jaffa. You see, your Legal Department disclosed Confidential Information with a person whom had no need to know and violated half a dozen federal laws.
I informed the foreigner that first and foremost, if Foreclosurepedia the Company never found the house how could we have allegedly taken anything from a neighbor? “The Contractor states you were there,” she replied. I asked whom the Contractor was. “Pinelands Preservation,” was the hissed reply from the thick, English as a Second Language voice.
Normally, I simply call my law school buddy and toss a couple of grand to sue folks in both Official and Individual Capacity, but I knew I was on solid ground here and wanted the entire scoop.
I informed the foreigner — and here I have to ask if there is even an Immigration and Naturalization Service (INS) Form I-9 on her as her English was so horrific — that I believed Safeguard Properties and more specifically Amir Jaffa was targeting me because I was a Member of the Media. I further stated that we had insurance to handle the matter and I would have my lawyer contact her.
She abruptly hung up.
So, the Shakedown was on. Safeguard Properties thought they would just threaten and intimidate me, ‘eh?! Not on my watch. My next call was to Pinelands Preservation. They informed me that Safeguard Properties had been hounding them for several days over the aforementioned order. I reinforced my position that Foreclosurepedia the Company could not have taken anything if we never found an address to have gone next door to take things from. You see, Bean Station is an extremely rural area.
Pinelands Preservation, by way of comparison to the vociferous and menacing tone Safeguard Properties had taken, were courteous and professional. A young lady informed me that they were aware Foreclosurepedia the Company was never at the property. I requested she pass my name through to her owner as I was previously involved with ancillary activities wherein he was privy to whom I was. I also reiterated my position that before our Insurance was to be hit, we would go to Court here in Grainger County, Tennessee, where we had Standing and Venue was Proper.
As promised by the Pinelands Preservation representative, she called me back — she called back in minutes. It had been determined that a different Contractor had actually found the property. Now, whether or not that Contractor did or did not do anything which was alleged by Safeguard Properties I do not know. I tend to think not as $15 grass cuts generally do not allow for the breaking and entering into of other homes — simply no money to be made when you are doing 20+ a day to merely pay for your gas.
My hat is off to Pinelands Preservation. They were courteous, professional and above all FAST! With respect to Safeguard Properties I am weighing my options as to whether or not I will sue them. When you call people and accuse them of Grand Larceny and to make it worse you make that accusation to someone whom had no legal right to possess that information, you open yourself up to liability.
I believe that this is a part of a growing trend by Members of the National Association of Mortgage Field Services (NAMFS). To date, only Members of the NAMFS have targeted me with threats of litigation. In the case of Safeguard Properties they threatened my freedom and to make my son fatherless. Make no mistake whatsoever we have entered into new and uncharted waters. This is an EXTREMELY PROVOCATIVE MOVE to make. The message would appear to be that Members of NAMFS will stop at nothing to silence me.
