The Legitimacy of Complaints and How They Backfire

The Mortgage Field Services Industry is on edge and has good cause to be. The backlash created by Members of the National Association of Mortgage Field Services and their refusal to demonstratively address fraud within its ranks against Contractors has created a vigilante setting of sorts with respect to Complaints filed with federal agencies. While often justified, Foreclosurepedia is beginning to see a trend of the utilization of Complaints as unjustified weapons in smear campaigns. This is a disturbing movement in that in the same way frivolous litigation is oft times used to cripple uncooperative firms, now Contractors are beginning to initiate costly battles with the US Government supplying the venue and firepower.

When unfounded Complaints are filed with US Government Agencies the stakes become quite high. What people seem to fail to realize is that submitting fraudulent work is one thing; when you submit a Complaint signed under Penalty of Perjury, the stakes now become your freedom.

What many people do not realize is that false accusations do not end with a Complaint being dismissed. The ramifications with respect to the potential loss of revenue, the costs to engage a Public Relations (PR) Campaign to attempt to remedy negative PR, the costs of defending against said accusations by both the initial victim and their Client(s) might easily roll into the millions of dollars if Contracts are actually lost. Foreclosurepedia knows well the tedious process of addressing these types of scenarios as we are currently under Contract by several National Association of Mortgage Field Services Rank and File as well as other non affiliated Firms.

The difference between addressing Complaints such as those which are frivolously filed with agencies such as the Consumer Financial Protection Bureau (CFPB) require a unique skill set. As opposed to simply addressing Google Search Engine Optimization (SEO), the successful conclusion of these operations require back channel and intermediary dialogue. Foreclosurepedia has been at the forefront of this with respect to the Mortgage Field Services Industry.

While I am loathe to interfere with the alleged fair process of inquiry, the reality is that CFPB is a power unto itself. Wherein the judiciary of the United States maintains the public perception of innocent until proven guilty, the Administrative Complaint Process within CFPB seems diametrically opposed to such. In fact, there is relatively little in publicly available material which either explains the laws, rules or regulations surrounding the process let alone allows for review. In fairness, though, CFPB is a relatively new player with respect to the regulation of those whom are within the Financial Segment. Regulation X which is relied upon heavily in how CFPB pulls rank in their procedural actions is really a smaller component of the entirety of the corpus of Dodd – Frank.

A demonstrative example of the dangers pertaining to CFPBs inquiry into Firms when pursuing Complaints is the case of the imprisonment of Sergeant Tamooressi in Mexico. In the United States, defense counsel would have met at multiple junctures with the prosecution and discussed exculpatory evidence and the matter would have been a mere by line months ago. Additionally complicating issues are the political gambits currently in play between Washington and Mexico. The analogy is identical, I believe, with respect to CFPB vis-a-vis the Consumer Complaint Process.

Benjamin Lawsky, New York’s Financial Regulatory Czar, has a hard on for Ocwen amongst others. Consumers are utilized as proxies to further shakedown pressure exertion upon Ocwen and other conventional and non conventional financial providers within the Mortgage Field Servicing landscape. I will be hammering out a substantial article on this over the weekend. Additionally, Foreclosurepedia reached out to federal investigators at CFPB for information with respect to how the Complaint Process works; Foreclosurepedia is in hopes that CFPB will be able to explain its position in light of a tremendous undercurrent of accusations that CFPB appears to be running a rogue and potentially unconstitutional ship.

Surprisingly, the National Association of Mortgage Field Services has remained silent with respect to the protection of its Membership from the veritable onslaught from CFPB. As a Trade Association, NAMFS should have gotten Eric Miller, NAMFS Regime Executive Director and Adam Miles, NAMFS Regime President and owner of Miles Preservation, off their lazy asses to begin a lobbying campaign with the K Street Boys. Instead, Miller and Miles are doing their best to twiddle their thumbs and continue to foster the protection of people like Heather Berghorst, the disgraced and former NAMFS Regime Secretary. As usual and most ironically, Foreclosurepedia is on the front lines protecting NAMFS Rank and File. — It is worthy to note the separation of NAMFS and NAMFS Regime.

In closing, Consumers and Contractors alike should pay close attention to whether or not their thousand dollar claims which have no merit are worth the risk of defending against protracted and asymmetrical litigation guaranteeing financial catastrophe. I want to reiterate that Foreclosurepedia is COMPLETELY SUPPORTIVE of legitimate Complaints. Foreclosurepedia will NOT STAND BY and allow for a minority of Contractors to potentially destroy the progress of the Mortgage Field Services Industry and its journey to rid itself of fraud. Foreclosurepedia welcomes dialogue with NAMFS vis-a-vis these issues which are coming up on the radar. The reality is that NAMFS is the Trade Association and should be taking lead on this issue. NAMFS, coupled with Foreclosurepedia’s intelligence apparatus, could create a positive environment for NAMFS Rank and File. If NAMFS, though, continues its recalcitrant attitude and cock blocking, its Membership will suffer greatly from this latest threat on the radar which the NAMFS Regime either failed to identify or knowingly ignored.
