CoreLogic: Getting Into That NAMFS Regime Swing

CoreLogic, a Member of the National Association of Mortgage Field Services (NAMFS) Regime, is front and center in Class Action Litigation with respect to their questionable Background Checks. The reality is that this is simply a snapshot of that which is to come for virtually each and every Member of the NAMFS Regime.

Law360, Los Angeles (January 06, 2014, 4:21 PM ET) — Job applicants accusing CoreLogic Inc. National Background Data LLC of selling background reports wrongly identifying them as criminals asked a Virginia federal judge Monday to certify the putative class in their Fair Credit Reporting Act complaint, arguing its members suffered uniformly.

Tyrone Henderson and James O. Hines Jr. were denied employment based on background reports that incorrectly said they criminals. Henderson and Hines filed suit in Virginia. The suit is captioned, Tyrone Henderson et al. v. CoreLogic Inc., et al., Case No. 12-cv-00097, U.S. District Court, Eastern District of Virginia. Henderson and Hines have also requested a Virginia federal judge to certify their class action lawsuit against CoreLogic Inc. and National Background Data LLC (NBD) under Rule 23.

Plaintiffs, in a nutshell, are saying the companies’ alleged violations of the Fair Credit Reporting Act (FCPA) made it impossible for anyone to get a legitimate background check from CoreLogic and NBD. Did I forget to mention that National Background Data LLC is actually an extension of CoreLogic? Ah, yes. You see, NAMFS Regime Members like to keep everything in house and hush hush when they reach out and royally screw people.

Here is the problem. You have all of these NAMFS Regime Members out trying to hock their half baked wares as they are loosing their collective asses and running out of Contractors to fuck. In the instant case, NBD conducted a background check of Henderson on behalf of a third party called Verifications. Verifications obtained their information from NBD whom is, in turn really CoreLogic. Now, why is this important?

Aspen Grove Solutions, the NAMFS Regime Member that Eric Miller and his hacks worked feverishly, in the dark of night, to shovel down the throats of Contractors — each and all receiving kick backs if you ask me — utilizes First Advantage to conduct their Investigations – Background Checks. First Advantage is FRONT AND CENTER on Verifications’ Website.

Now, while most NAMFS Regime Order Mills and Contractors were out drinking the Kool Aid Eric Miller and Adam Miles were serving up, everyone must have forgotten to read up a bit on FCRA. The reason I say this is that First Advantage, if the dots connect the way I believe they do, seems to have a real serious problem. Let me break this down as a Trained Media Professional,

CoreLogic uses National Background Data to conduct the bullshit Background Checks. CoreLogic fronts out the supposition that they aren’t really performing background checks; they are resellers.

The company’s own records indicate that the data they obtain is incomplete as it does not include Social Security numbers.  Problem is that all roads seem to lead back to First Advantage.

Top Class Actions, a website linking up potential Plaintiffs with Attorneys had this to say,

As the motion notes, “This omission is huge. There is no single identifier that is more important in narrowing and matching a search to a specific consumer. Defendant acknowledges this fact—that omission of SSN makes a correct match less likely.” To act without this information, the company should have provided a notice, and in fact there is a draft copy of such a notice for the resellers including ADP and Verifications, according to the motion.

Instead, while saying that the company is protected by the “strict procedures” standard of the FCRA, it includes contract language for resellers that notes its criminal background checks “do not comply with [California state statutes similar to the FCRA] for use in employment screening,” the motion states.

So, what we really have going on is NAMFS Regime Members whom have amongst them Companies whom defraud Contractors and are additionally pending Federal Racketeering Charges are now out collecting inordinate amounts of personal, financial and criminal histories. These are the very same firms whom, time and again, are involved in a tremendous amount of litigation and are single handedly responsible for atrocities currently being committed against women and children as is the case in the Buczek Enterprises matter. More on point, though, what we are now getting into is a very dangerous practice of Dark Pools collecting and generating reports to anyone whom seems willing to pay for them. The problem is that just like within the Mortgage Field Services Industry, there is no Regulation nor accountability. That may be soon changing, though.

ASONS is currently out on the stumping block attempting to force Contractors to suck up their Aspen Grove Solutions background checks. Here is a prime example of everything that is wrong with the the Industry. Pillaging the NAMFS Regime Membership rolls — or did Chuck Sockol simply step down because he and Milan needed some bonding time — wasn’t enough so they had to figure out how to prop up the Company to look better for Investors.

More on point, when you are paying people in days as opposed to some type of measurable net metric, you have employees. ASONS is ripe for the Independent Contractor versus Employee Class Action litigation coming. Have no doubt that I predict you will see a SHITLOAD of filings at the beginning of May. Anyone contemplating whirlwind purchases of these Order Mills will inherit the same razor sharp acuity I bring to bear as simply changing a name does not change the spots on the leopard.

Over the weekend, while I am up at the WordCamp Conference in Nashville, I am going to do some Live Broadcasts from the Nashville School of Law pertaining to ASONS. These folks are not going to slip out quietly. We are also going to dig deep and find out whom they are attempting to hock their wares to. No free passes; people do not destroy lives and then make money on it on my watch.

So, we will stay on top of this story as it unfolds. I will tell you this: If you are using Aspen Grove Solutions I am going to dig deep on you as a Company. As usual, all the usual suspects are in the Line Up. Nothing new with the NAMFS Regime.
